AT A GLANCE:
Consumers in Alabama, Arkansas, Georgia, Illinois, Indiana, Kentucky, Louisiana, Michigan, Mississippi, Missouri, Ohio, South Carolina, Tennessee, Texas, Virginia, and West Virginia who placed grocery delivery orders through the Kroger website or mobile app.
Kroger allegedly advertised grocery delivery purchases using headline prices while adding mandatory delivery-related charges later in the checkout process, including delivery fees, service charges, and preselected tips.
Consumers deserve to know the true cost of a purchase before reaching checkout. When mandatory charges are disclosed late in the ordering process, shoppers may end up paying more than expected. Consumers who paid these charges may be entitled to compensation.
Consumers using Kroger’s website and mobile application can place grocery orders for home delivery. Throughout much of the shopping experience, customers may see the advertised prices of products and build their carts based on those amounts.
However, during checkout, Kroger allegedly adds additional delivery-related charges that can significantly increase the total cost of the order. These charges may include a Delivery Fee, a Service Charge, and a preselected tip that appears before the consumer affirmatively chooses whether to leave one.
The investigation is examining whether Kroger adequately disclosed these charges throughout the ordering process and whether consumers were provided clear notice of the full cost of delivery before reaching the final stages of checkout.
